The agreement between you and MBC Kids Club Academy · Membership & Standalone Programs
These Terms and Conditions (“Terms”) are a legal agreement between you and mabellacalice OÜ, trading as MBC Kids Club (“we”, “us”, “our”), operator of the MBC Kids Club Academy at academy.mbckids.club (the “Academy”). By creating an account, enrolling in a course, or purchasing a Membership through the Academy, you agree to these Terms, our Privacy Policy and our Disclaimer.
If anything here conflicts with the general Terms of Service on mbckids.club, these Academy Terms take precedence for anything you do on the Academy platform.
1. Who is providing the Academy

2. What the Academy is
The Academy is our home education platform, hosted on Freshlearn, offering two products:

References to “courses” below mean any Membership course or Standalone Program accessed through the Academy.
3. Who can use the Academy
The Academy is designed for parents and guardians, not for children to sign up to. Accounts are for adults (18+) able to enter a binding contract. Children use the course content and activities under the supervision of the account-holding adult; they do not hold their own accounts or login credentials.
4. Your account
Keep your login details confidential — your account is personal to you and is not to be shared, transferred, or used simultaneously by multiple households. Please let us know at legals@mbckids.club if you believe your account may have been accessed without permission. We may suspend or close an account that breaches these Terms.
5. Payment and billing
- Membership is billed on a recurring basis (monthly or annual) via our payment processor, Stripe, until you cancel. By subscribing, you authorise us to charge the then-current fee to your payment method at the start of each period.
- Standalone Programs are billed once, in full, at checkout via Stripe.
- Where required by law, we will send a renewal reminder ahead of an annual Membership renewal.
- We may change Membership prices from time to time. We’ll give you reasonable advance notice by email before any change affects you, so you can decide whether to continue. Continuing to use the Academy after a price change takes effect means you accept the new price.
- Founding Member pricing, where offered, is locked in for as long as stated in the offer at the time you joined, provided your Membership remains continuously active. If you cancel and rejoin later, current pricing applies.
- If a payment fails, we may retry it and may suspend access to the affected course until payment succeeds.
- Prices are shown inclusive or exclusive of applicable tax as indicated at checkout.
6. Access and licence to materials
When you purchase Membership access or a Standalone Program, we grant you a personal, non-exclusive, non-transferable licence to access and use that course for your own household’s non-commercial, educational use. This licence does not permit you to:
- share your login or course access with anyone outside your household;
- copy, resell, sublicense, rent, or redistribute any course content, printable, video, or downloadable, in whole or in part;
- upload course materials to any public or shared platform, including resale or “free resource” sites;
- use course content for any commercial purpose, including running paid activities or classes for other children based on our materials, without our prior written permission.
All course content remains the intellectual property of mabellacalice OÜ (see section 12).
7. Cancelling your Membership
You can cancel your Membership at any time, either from within your account or by emailing legals@mbckids.club. When you cancel:
- your Membership stays active until the end of the period you’ve already paid for, and then ends;
- you will not be charged again after cancellation;
- once your Membership ends, you lose access to the Membership courses and any month-by-month content delivered through them, except where you separately purchased a Standalone Program, which you keep under section 2.
8. Refunds — Membership
Your first Membership payment is covered by the 14-day right of withdrawal in section 10: if you change your mind within 14 days of signing up, you can cancel for a full refund. After that 14-day window, and for every renewal, Membership fees are non-refundable. When you cancel, you keep access until the end of the period you’ve already paid for; we do not refund the unused part of a period.
9. Refunds — Standalone Programs (14-day guarantee)
For one-off Standalone Program purchases, we offer a 14-day money-back guarantee. If a program isn’t right for you, email legals@mbckids.club within 14 days of purchase with the program name, purchase date, and the name and email used. We’ll refund you, and your licence to that program’s materials ends — you must stop using and delete any downloaded materials.
10. Your statutory right of withdrawal (EU consumers)
If you are a consumer in the EU, you have 14 days to withdraw from an online purchase for any reason, starting from the day of purchase. This right applies to your first Membership payment and to Standalone Program purchases.
To withdraw, email us at legals@mbckids.club within 14 days, telling us what you bought and the email used. We will refund you — you do not need to give a reason. This statutory right applies to the initial purchase only; it does not reopen at each Membership renewal.
Please note: if you actively access or download course materials during the 14-day period, you are asking us to begin providing the digital content before withdrawal, which may affect your right to withdraw once the course has been fully accessed or downloaded, in line with EU consumer law on digital content.
11. Course content and updates
We may update, improve, reorganise, or occasionally retire course content over time, including within Membership courses and Standalone Programs. Where reasonably possible, we will maintain access to the substance of what you purchased; we do not guarantee that content will remain in an identical format indefinitely.
12. Intellectual property
All course content — including stories, activities, recipes, artwork, printables, worksheets, videos and any other materials made available through the Academy — is the copyright of mabellacalice OÜ, our licensors, or contributors, and is protected by copyright and other intellectual property laws. Purchasing access gives you the licence described in section 6; it does not transfer ownership of any content to you.
“MBC Kids Club,” “Mabella,” and related names and branding are our marks and may not be used without our permission.
13. Availability and technical requirements
Access to the Academy depends on a working internet connection and a compatible device and browser. We aim to keep the Academy available and functioning correctly, but we do not guarantee uninterrupted access — we may need to carry out maintenance, or the platform may occasionally be unavailable due to circumstances outside our reasonable control, including issues with our hosting provider, Freshlearn.
14. Educational disclaimer
MBC Kids Club Academy content is designed to support enrichment, play-based learning and family time. It is not a substitute for formal schooling, curriculum requirements, or professional educational, medical, or developmental advice, and we make no guarantee of specific learning outcomes. You remain responsible for deciding what is appropriate for the children in your care, including supervising any activity involving craft materials, food preparation, or tools.
15. Limitation of liability
To the fullest extent permitted by law, mabellacalice OÜ is not liable for any indirect, incidental, or consequential loss arising from your use of the Academy. Nothing in these Terms limits any liability that cannot legally be limited or excluded, including liability for death or personal injury caused by our negligence, or liability arising from fraud.
16. Suspension and termination
We may suspend or terminate your access to the Academy if you breach these Terms — for example, by sharing your account, reselling course content, or misusing the refund guarantee. Where reasonably possible, we’ll give you notice and a chance to put things right first.
17. Community features
Some parts of the Academy experience may in future include community or discussion features. These are not currently active. If and when they launch, additional terms covering their use will be added here and communicated to Members.
18. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms here and update the date below. Where a change is material, we will also notify active Members by email. Continued use of the Academy after a change takes effect means you accept the updated Terms.
19. Governing law and disputes
These Terms are governed by the laws of Estonia. If you are a consumer resident elsewhere in the EU, you also benefit from any mandatory consumer protections of your country of residence. Any dispute that cannot be resolved informally will be subject to the jurisdiction of the Estonian courts, without prejudice to any right you have to bring proceedings in your own country of residence as a consumer.
