Terms of Service
The agreement between you and MBC Kids Club for membership, courses and use of the Website
These Terms of Service (the “Terms”) are a legal agreement between you (“you”) and mabellacalice OÜ, trading as MBC Kids Club (“we”, “us”, “our”), the operator of mbckids.club (the “Website”) and its membership and academy (together, the “Service”).
Please read these Terms carefully. By creating an account, buying a membership or course, or otherwise using the Service, you agree to be bound by these Terms, our Privacy Policy and our Disclaimer, each incorporated here by reference. If you do not agree, please do not use the Service.
1. Who can use the Service
Accounts are for adults. You must be at least 18 years old and able to enter into a binding contract to create an account or make a purchase. The Service is intended for parents, guardians and educators who set up access for the children in their care. Children use the apps and activities under your supervision; they do not hold accounts of their own.
2. Your account
You are responsible for keeping your login details confidential and for activity under your account. The account is personal to you – please don’t share your login or let others access paid content through it. Tell us promptly at legals@mbckids.club if you think your account has been accessed without permission. We may suspend or close an account that breaches these Terms.
3. What you’re buying
We offer two main things:
- The Membership – ongoing access to digital content, downloadable activities and children’s apps, provided on a recurring subscription (monthly or annual, as shown at checkout).
- The Academy – individual courses and resources bought as one-off purchases.
The specific features, content and price of each are described at the point of purchase. We may add to, change or update the content of the Service over time; we aim to keep improving it, and occasional changes to particular activities are part of that.
4. Subscriptions, billing and price
- Recurring payment. A Membership renews automatically at the end of each billing period (monthly or annual) until you cancel. By subscribing, you authorise us, through our payment processor Stripe, to charge the then-current fee to your payment method at the start of each period.
- Renewal reminders. Where required by law, we will remind you before an annual renewal. You can see your renewal date in your account.
- Price changes. We may change subscription prices. We will give you reasonable advance notice by email before a change affects you, so you can decide whether to continue. Continued use after the change takes effect means you accept the new price.
- Failed payments. If a payment fails, we may retry it and may suspend access until payment succeeds.
- Taxes. Prices are shown inclusive or exclusive of applicable taxes as indicated at checkout.
5. Cancelling your Membership
You can cancel your Membership at any time, either from within your account or by emailing legals@mbckids.club. When you cancel:
- Your Membership stays active until the end of the period you have already paid for, and then ends.
- You will not be charged again after cancellation.
- Except where the 14-day withdrawal right applies to your first payment (section 8), cancelling part-way through a period does not entitle you to a refund of that period – you keep access until it ends.
6. Refunds – Membership
Your first membership payment is covered by the 14-day right of withdrawal in section 8: if you change your mind within 14 days of signing up, you can cancel for a full refund. After that 14-day period, and for every renewal, Membership fees are non-refundable. When you cancel, you keep access until the end of the period you have already paid for, and we do not refund the unused part.
7. Refunds – Academy courses (14-day guarantee)
For one-off Academy course purchases we offer a 14-day money-back guarantee. If a course isn’t right for you, email legals@mbckids.club within 14 days of purchase, telling us the course, the purchase date, and the name and email used. We will refund you, and your licence to use that course’s materials ends – you must stop using and delete any downloaded materials. Each customer may use this goodwill guarantee reasonably and in good faith; we may decline it where there are clear signs of abuse.
8. Your statutory right of withdrawal (EU consumers)
If you are a consumer in the EU, you have 14 days to withdraw from an online purchase for any reason, starting from the day of purchase. This right applies to your first Membership payment and to Academy course purchases.
To withdraw, simply email us at legals@mbckids.club within 14 days, telling us what you bought and the email used. We will refund you. You do not need to give a reason.
This statutory right applies to the initial purchase. For a Membership, once that 14-day period has passed your subscription continues on the cancel-anytime basis described in sections 5 and 6: you can stop it whenever you like, you keep access until the end of the paid period, and renewals are non-refundable.
(Our 14-day money-back guarantee on Academy courses in section 7 mirrors this statutory right and, where it goes further, is offered as a goodwill policy on top of your statutory rights, not a replacement for them.)
9. Licence to use the content
Everything in the Service – activities, downloads, apps, text, illustrations and the MBC Kids Club and Mabella branding – belongs to us or our licensors and is protected by copyright and other rights. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the content for your own family’s, household’s or single classroom’s educational use, for as long as your access is valid.
You may print and use downloads for those purposes. You may not resell, redistribute, publish, share publicly, sub-license, or create competing products from the content, or remove our notices or branding. Schools or co-ops wanting wider use should contact us for a licence.
10. Acceptable use
When using the Service you agree not to: use it unlawfully or for any prohibited purpose; copy, scrape, reverse-engineer or try to extract content beyond what is intended; share paid content with people outside your household or classroom; upload anything harmful, infringing, or that you do not have the right to share; or interfere with the security or operation of the Website. We may suspend or end access if you break these rules.
11. Children’s apps and supervision
The apps and activities for children are made to be used under your supervision. They are educational and for general informational purposes, and – as set out in our Disclaimer – they are not a substitute for professional educational, medical or psychological advice. You decide what is suitable for your child. The apps do not collect personal data from children (see our Privacy Policy), and they are fixed – they do not use AI or respond dynamically to your child. Some of our wider content is created with the help of AI tools under human direction and review; see the “How we use AI” section of our Disclaimer.
12. Community features
The Service does not currently include comments, forums, uploads or a community area. If we add them in future, additional community rules will apply and will be made available at that time. In particular, any feature that lets users post or upload content will be governed by acceptable-use and content rules, and we will set out then how any data from such features is handled.
13. Availability and changes to the Service
We work to keep the Service available but cannot guarantee it will always be uninterrupted or error-free. We may update, suspend or withdraw parts of it, and may carry out maintenance. We will try to give notice of significant planned changes where we reasonably can.
14. Disclaimers and limitation of liability
The Service is provided for educational and general informational purposes. To the extent permitted by law, we provide it “as is” and do not guarantee particular educational outcomes. Our full Disclaimer forms part of these Terms.
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so – including liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under mandatory EU or Estonian consumer law. Your statutory rights as a consumer are not affected by these Terms.
Subject to that, we are not liable for indirect or consequential loss, or for loss arising from your failure to use reasonable judgement when using the content. Where we are found liable, our total liability to you is limited to the amount you paid us for the Service in the 12 months before the claim arose.
15. Suspension and termination
We may suspend or end your access if you materially breach these Terms (for example by redistributing paid content or misusing the Service). You may stop using the Service and close your account at any time. Sections that by their nature should survive – such as licence restrictions, disclaimers, liability limits and the governing-law clause – continue to apply after termination.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of Estonia, where the company is registered. As an EU consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring proceedings in your local courts; nothing here removes those rights.

17. General
If any part of these Terms is found unenforceable, the rest continues to apply. Our not enforcing a right on one occasion doesn’t waive it. We may transfer our rights and obligations under these Terms to another business (for example if our company is sold), but this will not affect your rights. These Terms, with the Privacy Policy and Disclaimer, are the entire agreement between us about the Service.
18. Changes to these Terms
We may update these Terms from time to time. When changes are material, we will post the new version here and, where appropriate, notify account-holders by email. For existing subscriptions, changes that affect you will take effect from your next renewal where the law requires. Continued use after changes take effect means you accept them.
